  • The Santa Clara County Health Department requires additional permits if food samples are provided. The cost of the permits is the responsibility of the exhibitor in addition to booth space fees. You will be contacted to work through the logistics.

  • 1. I, THE APPLICANT, HEREBY ABSOLVE THE San Jose Department of Parks, Recreation and Neighborhood Services, Bay Area Community Development Services, Berryessa Business Association and the Festival Committee of responsibility and liability for loss or damage to my work by any cause.

  • 2. I, the applicant, in consideration of participation in the Berryessa Art & Wine Festival, agree to indemnify and hold the City of San Jose, Berryessa Business Association and Bay Area Community Development Services harmless, and release the City, Berryessa Business Association and Bay Area Community Development Services from any and all liability for any injury and/or property damage, which may be suffered by the above-named individual participating in the Festival, arising out of or in any way connected with participation in this Festival.

  • 3. All items I, the applicant, will be presenting for sale will be listed on the application or approved in advance by the BAWF chair. If prior approval is not obtained, I may be asked to remove those items from my display.

  • 4. I, the applicant, understand booth spaces are limited to 10 by 10 and that corner booth spaces may be limited and cannot be guaranteed because they were requested.

  • 5. I, the applicant, will provide canopies, tables, canopy weights for my canopies to prevent them from blowing away per San Jose Fire Department requirements.

  • 6. I, the applicant, understand the Festival is held regardless of weather and that no refunds will be made because of inclement weather.

  • 7. I, the applicant, understand electrical power is NOT available or provided. Due to City regulations and the San Jose Fire Department, Gas Generators ARE NOT ALLOWED. Diesel generators may be permitted, if you wish to bring and use a diesel generator, you must receive approval from the Festival Committee in advance.

  • 8. The selling or serving of alcoholic beverages is strictly prohibited and will result in immediate removal from the festival.

  • 9. Disregard of the laws of the State of California, City of San Jose and park rules will result in immediate removal from the festival.

  • 10. I, the applicant, understand and agree to abide by setup and take-down time schedules. Late arrivals will forfeit their entry fee and participation in the festival. Early take-down is NOT ALLOWED as it endangers all festival participants.

  • 11. Setup 7:30-9:00 am, Take-down 5 pm. Instructions for parking and designated curb for unloading will be provided after application approval.

  • The following items must be emailed to berryessaAWF@gmail.com upon submission of your application before we will consider your application:

  • 1. Color photos of items to be sold (4-6)

  • 2. California Resale Permit

  • 3. Proof of vehicle insurance for All vehicles to be driven on grounds. One car per booth space permitted to park. One additional vehicle per booth space permitted to help with set-up and removed by 9:00 AM.
