As the Affordable Care Act begins to take effect in the coming years, companies will be subject to a number of requirements that may affect their operations and strategic planning.

Speaker: David E. Schweighoefer, Walter & Haverfield, and Adjunct Professor, Cleveland-Marshall College of Law

David Schweighoefer is a partner with Walter & Haverfield and has over 25 years of combined law firm and hospital administration experience. He has served as the Chief Executive Officer for hospitals in Wisconsin and Ohio, and served as the Chief Operating Officer for a multi-hospital system in northeast Ohio. He has been a partner in an of-counsel capacity at two large law firms in the health care practice groups of both, and successfully developed his own solo practice before joining Walter & Haverfield. He also is an adjunct Professor of Law at Cleveland Marshall College of Law, as well as Lake Erie College.

David frequently advises clients on matters including: regulatory and corporate compliance program development, patient rights, and informed consent policies and procedure development; FCA, Anti-kickback and Stark I, II & Phase III guidance to private clients; physician employment and recruitment contracts, compliance guidance for Medicare Secondary Payer requirements; and managed care contracting, lab and pharmacy contract review, and IDTF lease and equipment agreements.

In his practice, David has also designed and implemented Stark compliant physician compensation programs, employment contracts, and corporate compliance programs; advised hospital providers on HCQIA Fair Hearing procedures; and guided facilities and providers in their efforts to operate successfully in changing regulatory environments. He has assisted them in other areas as well, including achieving and maintaining regulatory compliance with the Joint Commission Standards, AOA, CMS, ODMH, and the Ohio Department of Health; interpreting Medicare Physician Fee Schedule issues; providing RAC audit compliance advice; and acquiring assisted living facilities.
