Recent Developments in Long-Term Care in Massachusetts
with Scott Plumb

Scott Plumb, Senior Vice President of the Massachusetts Senior Care Association, will disucss a number of recent developments in long-term care in Massachusetts including:

  • Recent changes to the guardianship law allowing short stay admissions to be exempted from the prior law requiring prior court permision before admission for individuals with guardians.
  • Sections of the recently enacted state global payment law that impact long-term care including an amendment allowing greater flexibility in moving individuals to different living quarters in nursing facilities if their clinical conditions have change.
  • MassHealth's anticipated regulatory changes regarding the treatment of prior eligbility medical expenses.
  • Changes in the demand for post-acute and long-term care servicse and teh strategies that organizations are taking to survive in a very challenging future.
  • MassHealth and it's proposed change in the treatment of Prior Eligibility Medical Expenses when determining Medicaid nursing facility patient-paid amounts.
  • Changes to the state's Uniform Probate Law, in particular the new exemption for short stay admissions to nursing facilities of individuals with guardians from the prior court approval requirement imposed by the original law.
  • Two amendments to the recently enacted state global payment law, one modifying the requirement for moving individuals whose clinical needs have changed to different living quarters in the nursing facility and the other requiring the state to file a waiver with CMS of the three-day prior hospital stay requirement for accessing Medicare Part A-funded nursing facility coverage.
