Course Description and Objectives: This webinar will provide guidance to university general counsel, athletics administrators and other higher-education professionals to enhance internal and external investigations of alleged NCAA rules-violations by reviewing the evidentiary and procedural principles, decisions and framework of the NCAA Committees on Infractions and Infractions Appeals Committees. Specifically, presenter Michael Buckner, a higher-education and sports law attorney with significant NCAA infractions hearing experience, will cover the committees’ case-precedent regarding evidentiary issues and procedural standards, including, but not limited to: affidavits; notices of appeal; hearing appearances; clerical errors; conflicts of interest; due and fair process; evidence rules; hearing record; transcripts; inadmissible information; adequate notice; hearing objections; penalties; reliability and credibility of information; right to legal counsel; standard of proof; standing; and witness testimony. Throughout the webinar, Mr. Buckner will offer tips on avoiding investigative, evidentiary and procedural errors during the enforcement process. Using hypotheticals based on real-life events, as well as insight from prior infractions cases, webinar participants will cover:
