Program Summary:
Management Rights refers to the general right of management to manage the business and direct the workforce. Collective Agreements contain provisions that expressly recognize management rights. Despite this recognition, disputes often arise when the employer seeks to unilaterally make changes at the workplace without the agreement of the Union. Recently, such changes as increasing wages for some employees, allocating work, introducing drug and alcohol policies and imposing retirement rules have been the subject of court or arbitration board decisions.

This webinar will identify recent decisions in which the scope and limitations on management rights have been adjudicated, seek to garner applicable principles from the decisions and discuss strategies for when an employer should rely on management rights as opposed to collective bargaining to implement specific changes at the workplace.

Presenters:
Michael Watt, is the leader of the Labour & Employment Practice Group at Alexander Holburn Beaudin & Lang LLP. His practice involves providing time-sensitive legal advice to both businesses and employees in the areas of labour, employment and human rights laws, and defending and prosecuting claims through the Court and administrative tribunal processes. His clients include local, national and international businesses, as well as employees seeking advice on workplace issues.

Sarah Hellmann, is a member of the Labour and Employment Practice Group at Alexander Holburn Beaudin & Lang LLP. Sarah's practice focuses on general civil litigation and frequently involves disputes pertaining to employment matters and human rights. Sarah also practices administrative law. She is a member of the Executive of the BC Branch of the Employment Law Section of the Canadian Bar Association.
