Lunch & Learn! Prop 65 Compliance- What You Need to Know! 

Part 1- Businesses’ requirements to comply with California’s Safe Drinking Water and Toxic Enforcement Act (known as Prop 65) changed August 30, 2018. The two-year grace period to comply with the amended regulations has come to an end. 

Prop 65 requires manufacturers, distributors and retailers to provide “a clear and reasonable warning” to California consumers before exposing them to one of nearly 900 chemicals identified by the state as causing cancer or reproductive toxicity. The amended regulations dictate how the warning must be given and what language must be used. 

Have you taken the necessary steps to comply with the updated law? 

Failure to comply with Prop 65 subjects manufacturers, distributor and retailers with 10 or more employees to potential liability, including penalties of up to $2,500 per day, per violation. 

The first part of this course will discuss the amended regulations, the specific updated language that must be used to warn consumers, and best practices to comply with Prop 65. The course is designed to be understandable to those new to the law, as well as to provide useful and practical advice to those with significant experience with Prop 65. 

Part 2- ACE Products & Consulting will give an in-depth look into compliance testing, specifically California Prop 65. This will cover the equipment needed, testing methods and the advantages of each method.

Yelena Boxer is a partner in Benesch's Litigation Practice Group. She concentrates her practice on complex commercial litigation. Frank Pappas, Consultant, ACE Products & Consulting LLC

Frank Pappas graduated with his Bachelor of Science in Chemistry from Kent State University with an emphasis on analytical instrumentation. His early work was concentrated on the testing of environmental, pharmaceutical and raw material samples by various analytical techniques.  While working in the tire industry Frank increased his responsibilities to include rubber compounding and formulations that would extend over a variety of applications, up to and including polymer mixing and processing. Currently he is pursuing his Masters in Polymer Science and Polymer Engineering from the University of Akron.
