This panel presentation will discuss types of retaliation in the workplace claims that are frequently asserted, including Title VII, ADA, ADEA, FMLA, Worker’s Compensation, First Amendment, and Whistleblower claims. The presentation will address the law related to these types of claims, best strategies in defending employers from asserted claims, and tactics to prevent additional claims from arising both during litigation and after. Attendees will learn what constitutes protected activity, what constitutes retaliation (and, more importantly, what does not constitute retaliation), the causal relation an employee must prove, and the defenses an employer may assert.
