All defense counsel who is retained by an insurance carrier to represent an insured must know and understand the tripartite relationship, i.e., an alliance between that attorney, the insured and the insurer with the common goal of reaching a favorable resolution of the claim. This presentation will discuss the ethical issues involved with this relationship, including where the attorney’s loyalty lies, the attorney-client and work product privilege, and what to do if the interest of the carrier and your client conflict.
