from EEOC Conciliation and Litigation

This program will involve discussions about the EEOC process beyond the typical mediation and investigation process. It will include discussion of the conciliation process with the EEOC following a finding of probable clause, including statutes that govern disclosure of information and the negotiation process toward an agreement. It will also cover the litigation process when conciliation is unsuccessful and the EEOC files suit. The program will involve lessons learned, aimed to help attorneys strategize on future similar matters.

1. EEOC general process
2. What happens when the EEOC makes a finding of probable cause that the applicable statutes may have been violated 

  • Rebuttal submissions: What evidence EEOC is required to provide and what remains secret
  • Conciliation negotiations: The players involved
  • Agreement terms and conditions: Lessons learned
  • Implementation process of agreement terms: Lessons learned
